By accessing or using HotelStayNow.com, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the website or services.

2. Our Role as a Booking Platform

Hotel Stay Now LLC acts as an online hotel booking platform.

  • We process reservations and payments on behalf of participating hotels.
  • Hotels are independent third-party providers responsible for accommodation services.
  • The hotel is solely responsible for the quality, condition, and delivery of the stay.

Hotel Stay Now LLC does not own, manage, or operate hotels.

3. Payments & Accepted Methods

Hotel Stay Now LLC processes payments at the time of booking using the following methods:

  • Major credit and debit cards
  • Apple Pay
  • Google Pay
  • Link (L-I-N-K)
  • Buy Now, Pay Later services (Affirm and Klarna)
  • Stablecoins and other supported cryptocurrencies

Buy Now, Pay Later (Affirm & Klarna)

  • When using Affirm or Klarna, a 6% markup is added to the room price to cover financing and operational costs.
  • Financing terms, approvals, and repayments are handled directly by Affirm or Klarna.
  • Hotel Stay Now LLC is not responsible for financing decisions or repayment schedules set by these providers.

4. Pricing, Rates & Availability

  • Prices and availability are determined by the hotel and may change at any time.
  • Rates may be refundable or non-refundable, depending on the hotel’s policy.
  • Hotel Stay Now LLC does not guarantee availability or price accuracy in the event of technical or supplier errors.

5. Refunds & Cancellations

  • All refunds and cancellations are governed by the individual hotel’s cancellation policy, which is displayed during the booking process.

    • Non-refundable rates are not eligible for refunds
    • Refundable rates are subject to hotel-specific deadlines and conditions
    • Hotel Stay Now LLC does not charge separate processing or cancellation fees

Cancellation Requests

  • Guests must contact Hotel Stay Now LLC directly to request cancellations or changes
  • Failure to contact us prior to filing disputes or chargebacks may result in account suspension
  • Approved refunds are processed back to the original payment method, subject to hotel approval and processing timelines

6. Chargebacks & Disputes

Guests agree to contact Hotel Stay Now LLC first to resolve any issues.

  • Filing a chargeback without contacting us may be considered a violation of these Terms
  • Abuse of chargebacks may result in account suspension or termination
  • Booking confirmations, hotel policies, and transaction records may be used to dispute invalid chargebacks

7. Hotel Responsibilities

Hotels are solely responsible for:

  • Room condition and cleanliness
  • Amenities and on-site services
  • Overbooking situations
  • Safety, accessibility, and guest experience during the stay

Hotel Stay Now LLC is not responsible for hotel performance or guest satisfaction during the stay.

8. User Responsibilities

You agree to:

  • Provide accurate booking and payment information
  • Review hotel policies before booking
  • Comply with hotel rules and applicable laws
  • Use the platform for personal, non-commercial purposes

Fraudulent activity or misuse of the platform may result in account suspension or termination.

9. Limitation of Liability

To the maximum extent permitted by law, Hotel Stay Now LLC shall not be liable for:

  • Hotel service failures or deficiencies
  • Denied stays or overbookings
  • Hotel-related disputes
  • Indirect, incidental, or consequential damages

Hotel Stay Now LLC’s total liability, if any, shall not exceed the total amount paid for the booking in question.

10. Disclaimer of Warranties

HotelStayNow.com is provided “as is” and “as available.”

Hotel Stay Now LLC makes no warranties regarding:

  • Hotel quality or services
  • Availability of accommodations
  • Accuracy of third-party content
  • Fitness for a particular purpose

Use of the platform is at your own risk.

11. Indemnification

You agree to indemnify and hold harmless Hotel Stay Now LLC from any claims, losses, damages, or expenses arising from:

  • Your use of the platform
  • Your violation of these Terms
  • Disputes between you and a hotel

12. Intellectual Property

All content, branding, trademarks, and technology on HotelStayNow.com are the property of Hotel Stay Now LLC or its licensors and may not be copied, reproduced, or distributed without permission.

13. Modifications to These Terms

Hotel Stay Now LLC reserves the right to update these Terms at any time. Continued use of the platform constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the United States and the applicable state of company registration, without regard to conflict-of-law principles.
